On Sept. 8, Rep. Rick Allen, R-Ga., a member of the House Education and Labor Committee, introduced the ABC-supported Truth in Employment Act, H.R. 5178. This legislation would amend the National Labor Relations Act to protect small businesses and their employees from the coercive tactic used by big unions known as 鈥渟alting,鈥� which makes small businesses targets of harassment campaigns designed to increase forced unionization.

On Jan. 29, 2016, the U.S. Equal Employment Opportunity Commission (EEOC) announced a proposed rule expanding the data that is collected from certain employers on the Employer Information Report (EEO-1). Currently, certain federal contractors with 50-99 employees and private employers with more than 100 employees must report annually the number of individuals they employ by job category and race, ethnicity, and sex on the EEO-1. The Equal Employment Opportunity Commission (EEOC) Oct. 30 issued a proposed rule under the Genetic Information Nondiscrimination Act (GINA) that would authorize employers who offer wellness programs to provide inducements for an employee鈥檚 spouse, who is also a participant in the employer鈥檚 health plan, to disclose their current or past health information. Under the proposal, total incentives provided to an employee and his or her spouse for participating in a wellness program that is a part of a group health program that collects this information may not exceed 30 percent of the total cost of the health plan in which they are enrolled.
