The Federal Motor Carrier Safety Administration (FMCSA) Aug. 7听posted an enforcement policy听on its website, effective immediately, that clarifies it will not apply the provision under its revised hours of service (HOS) rule that requires drivers to take a 30-minutes break for every eight hours of consecutive driving to short-haul drives.听

As part of a deal to avert a 鈥渘uclear option鈥� to end filibuster rules in the U.S. Senate, the nominations of Richard Griffin and Sharon Block to the NLRB were withdrawn. Griffin and Block were two of the members听illegally recess appointed听to the board by President Obama in 2012. They听were renominated听by the president in February.听

The听U.S. Court of Appeals for the Third Circuit May 16 ruled听that President Barack Obama鈥檚 recess appointments to the National Labor Relations Board (NLRB) between March 2010 and January 2012 were unconstitutional. The ruling, which supports a听Jan. 25 decision听by the U.S. Court of Appeals for the D.C. Circuit invalidating the January 2012 recess appointments of Democrats Sharon Block and Richard Griffin, also invalidates the March 2010 recess appointment of Craig Becker.听
